OAKLAND — A former Moraga Chamber of Commerce president was charged in a complaint unsealed in U.S. District Court on Wednesday with counts of wire fraud, aiding and abetting and filing a false tax return, a U.S. Justice Department spokesperson said.
According to the complaint, F. Robert Fritzky served as treasurer for the Moraga Community Foundation and a member of its board of directors, responsible for maintaining its bank accounts and tracking its funds, assets and liabilities, and had access to two foundation bank accounts.
During a period of just over three years starting in June 2016, Fritzky, who was the majority owner of medical and pharmaceutical company MedMatRx LLC, allegedly wrote four dozen checks totaling $20,838,17 to the company, and four checks to himself for $14,345.10.
“MedMatRx,LLC did not provide services to the Foundation,” the charging document alleges.
He also wrote ten checks totaling $37,188 to the Jeannette Fritzky Foundation, a nonprofit charity founded in November 2018 and named for his late wife, a former Moraga Town Council member who died in September 2018 soon after a lung cancer diagnosis.
In November 2018, Fritzky filed a signed and prepared 2017 tax return for the Moraga Community Foundation, with a declaration made under the threat of perjury, claiming its “cash, savings, and investments” at year’s end totaled $111,275.
In a January 2019 financial report that Fritzky sent to the Moraga Community Foundation’s board of directors e-mail account, Fritzky claimed ending balances in December 2018 for one foundation fund as more than $108,000 and more than $37,000 for the other. Both funds’ combined balances were actually less than $2,000.
When Fritzky’s term as foundation treasurer ended in July 2019, he ignored requests from incoming treasurer Wendy Scheck, who was eventually able to get access to its accounts with help from a bank.
Fritzky was removed from the foundation’s board of directors in a special meeting Sept. 3, 2019, and ousted as Moraga Chamber of Commerce president days later.
He drew harsh rebuke from Moraga Mayor Roger Wykle in a statement posted to the town’s Web site.
Charges against Fritzky are allegations, and defendants are considered innocent until proven guilty beyond a reasonable doubt. In addition, any sentence would depend on court discretion and consideration of statutory factors and federal guidelines.
